Questions
Edible Gummies Shipping Laws in California: What's Legal
In California, only licensed dispensaries can legally deliver THC gummies within the state. USPS, UPS, and FedEx cannot ship them. CBD gummies derived from hemp are federally legal and can be shipped. For same-day delivery in Tracy, order from Garden of Eden by 7pm.
Can You Legally Ship THC Gummies Within California?
THC gummies cannot be shipped through USPS, UPS, or FedEx because cannabis is federally illegal. Only a licensed California dispensary can legally deliver them to your home. Here's how it works:
- Understand the law – The California Department of Cannabis Control (DCC) licenses dispensaries to sell and deliver cannabis products, including edible gummies, within the state. Delivery is legal only from a licensed retailer.
- Know what's prohibited – Mailing THC gummies via any common carrier is illegal. If a website offers to ship them through the mail, it is not a licensed California dispensary.
- Order from a licensed dispensary – Use the DCC's license lookup tool to verify a retailer before ordering. For Tracy residents, Garden of Eden is a licensed dispensary since 2003.
- Place your order – Order online or by phone. At Garden of Eden, order by 7pm for same-day delivery within the Tracy area.
- Receive your delivery – A staff member will bring your gummies to your door. The delivery fee is a flat $5.

CBD Gummies vs. THC Gummies: Shipping Rules Compared
Understanding the difference between CBD and THC gummies is key to knowing what can be shipped to your door. Here's a comparison:
| Factor | CBD Gummies (Hemp-Derived) | THC Gummies (Marijuana-Derived) |
|---|---|---|
| Legal status | Federally legal under the 2018 Farm Bill (less than 0.3% THC) | Illegal federally; legal in California for licensed sales |
| Shipping via mail | Can be shipped via USPS, UPS, FedEx | Cannot be shipped via any common carrier |
| Delivery from dispensary | Available from some retailers, but not always | Legal only from a licensed California dispensary |
| License required to sell | No special license for hemp CBD (but must comply with FDA) | Must be sold by a licensed California dispensary |
| Same-day option in Tracy | Available from some online stores (varies) | Available from Garden of Eden with same-day delivery |
If you want to buy THC gummies for delivery in Tracy, you need a licensed dispensary like Garden of Eden. For CBD gummies, you can order from many online retailers, but verify the source is reputable.
